Extortion is the crime of obtaining money or property or services by the use of coercion. The coercive act can be threats of violence or destruction of property and they can be made verbally, in writing and over the internet. It is still extortion to demand money that is owed where illegitimate threats of harm are made such as violence.

The offence is one which amounts to a criminal lifestyle as defined by s142 of the Proceeds of Crime Act 2002. Any proceeds from a crime of extortion is recoverable from an accused convicted of this offence

Examples of Extortion

An example of a straight forward extortion is where someone sends a letter demanding money under pain of violence, were the victim not to comply.

A more complex example is known as cyber extortion, where large companies are targeted via computer systems they rely upon. Ransoms are demanded for the return of sensitive data or the reinstatement of operating systems which has been deliberately prevented the company from running.

There is a distinction between extortion and blackmail: while both involve the victim being illegally induced to hand over money etc., blackmail usually involves threatening someone who has themselves been in the wrong or committed a criminal act, and who is then targeted by another to pay them money etc. to prevent them from disclosing the error of the victim to the police or to their employer or family and friends.

Penalties for extortion can be severe. If you have been charged with extorsion, it is imperative that you obtain competent and expert legal advice as fast as possible. This is a highly specialised area of the law and selecting the right Solicitor Advocate is vital.
